UNDERSTANDING and DISCLAIMER
Physicians' Health Care Consulting, Inc. (PHCC) will treat ALL communications
with complete confidence. Any potential conflicts of interest will be disclosed
immediately. We will review the material sent to us and respond to specific
inquiries, or if appropriate, review in a more comprehensive manner. It is
essential that complete information be provided to prevent errors.
An estimate of the expenses involved will be discussed before any agreement to
proceed is concluded. Unless previously agreed to, one-half of the estimated
cost will be pre-paid prior to commencing the project. Additional costs
associated with communications, mailings, etc. will be a pass through expense.
Although not essential, telephone or in person communications often are of value
and prevent misunderstandings and confusion.
Any physicians who review records will be board certified and licensed. There is
an understanding that PHCC reviewers are NOT committed to act as EXPERT
witnesses for depositions or trial, rather the material prepared will be
non-discoverable work for the client, defense or plaintiff attorney's use. If
requested, attempts may be made by PHCC to obtain EXPERTS.
It should be explicitly clear that the opinions rendered by PHCC or any of their
employees are not facts but opinions based upon their review of material
provided. It should be understood that any mistakes by commission or omission by
either PHCC or its employees are unfortunate but possible and PHCC and their
employees assume no liability for such errors.
Physicians’ Health Care Consulting, Inc. (“PHCC”) is not authorized by state law
to provide medical care or advice nor legal services, and, therefore, PHCC does
not, and cannot, provide such services. It is expressly agreed that Consultee
does not desire to receive medical care nor legal services from PHCC and PHCC
will not provide such services. Consulting services furnished by PHCC under
this Agreement shall be limited to a review and analysis of past medical
treatment of the Review Subject by other health care providers, and the services
of PHCC shall -constitute neither the practice of medicine nor the practice of
law. PHCC agrees to provide initial case review and, if acceptable to Consultee,
a complete case review and work up, as set forth below. The scope of the review
and consultation will be defined by the proposal submitted to the Consultee
following the initial case review, and will consist of a summary and analysis of
medical records regarding past treatment of the Review Subject. The purpose of
the consulting services rendered by PHCC is to assist in the analysis of records
and other medical documents and to provide a clear understanding to the
Consultee of the contents of such records and documents. PHCC does not make any
determination, and PHCC does not offer any opinions or advice regarding, proper
current or future medical treatment of the Review Subject.
It is understood and agreed that PHCC is not Consultee’s nor the Review
Subject’s physician or attorney, and that PHCC is not rendering medical services
or advice nor legal services or advice. Therefore, neither Consultee nor the
Review Subject shall have any doctor/patient or attorney/client privilege as to
any communications with PHCC or as to the contents of any records, charts, or
other documentation that will be provided to, or discussed with, PHCC.
